High rise residential development | Building Safety Act Remediation Contribution Order Proceedings | £13m claim value

Background 

Vista Tower is a 49.5m residential tower affected by multiple fire safety defects identified following post-Grenfell investigations. The dispute concerned the nature and extent of the defects within the external wall systems, the building safety risks they created, and whether the proposed remediation strategy was reasonable and proportionate.  

Expert architectural evidence was provided through a comprehensive Expert Report examining the original conversion works, the development of the fire safety strategy, the design and construction of the external wall systems, and the evolving regulatory landscape following Grenfell. The appointment required detailed consideration of historic Building Regulations, government guidance, PAS 9980 assessments and the relationship between the identified defects and the remediation works being proposed.  

The expert analysis assisted the First Tier Tribunal in distinguishing between defects that required remediation and those that did not, assessing the building safety risks presented by the various elements of the construction, and considering whether the scope of the remedial works was necessary, reasonable and proportionate in the circumstances.  

The proceedings ultimately resulted in Remediation Contribution Orders exceeding £13 million. The wider Vista Tower litigation subsequently culminated in the Upper Tribunal decision in Edgewater (Stevenage) Limited and Others v Grey GR Limited Partnership [2026] UKUT 18 (LC), which provided important guidance on the operation of Remediation Contribution Orders under the Building Safety Act 2022.
